Like spinal cord injuries, TBI may be caused by a sudden traumatic accident or intentional act that involves a sudden jolt, bump or blow to the head.
According to the CDC, the most common causes of TBI are:
- Falls. More than one of three traumatic brain injuries is the consequence of a slip or fall. About half of the TBIs suffered by children 14 years and younger are the result of falls. More than 60 percent of TBIs suffered by people 65 and older are the result of falls.
- Auto, motorcycle or trucking accidents. The second leading cause of TBI in the United States is motor vehicle accidents. It is also the leading cause of TBI deaths, nearly 32 percent of all TBI deaths are linked to car accidents.
- Being struck by a moving object or striking a stationary object. This mechanism of injury is responsible for 16.5 percent of all traumatic brain injuries.
- Assault. One in 10 TBI cases is the result of a physical attack or altercation.
A TBI may be mild, moderate, severe or fatal. Traumatic brain injury survivors may suffer temporary or permanent changes that affect thought, sensation, language or emotion. TBI victims may also be at greater risk for epilepsy, Parkinson's disease, Alzheimer's disease and other brain disorders.
For TBI victims and their families, the cost of immediate long-term care medical care and support services can be extremely expensive. However, if a TBI was caused by the carelessness, negligence or intentional act of another, you may be entitled to compensation from the party who caused the injury.
A successful Missouri or Illinois traumatic brain injury lawsuit could result in a monetary recovery that will help provide care for the TBI victim. It could also help reduce the impact of lost wages if the victim can no longer work. A wrongful death lawsuit may also help cover medical bills and lost income for a family who has lost a loved one to TBI caused by another person.
But the time in which you may file a lawsuit after a traumatic brain injury is limited in both Missouri and Illinois. It's important to contact an experienced traumatic brain injury lawyer as soon as possible after an injury to ensure that important evidence isn't lost and that your claim is not barred by the state's statute of limitations.
