What is Cerebral Palsy?
The word cerebral means ‘of the brain’ and the word palsy means ‘lack of muscle control.’ Therefore, cerebral palsy is a term that refers to several disorders that affect a person’s ability to move. This condition is permanent, but does not generally get worse over time. Cerebral palsy is the result of damage to a babies developing brain during pregnancy or childbirth.
Each person is effected differently by the condition. It can affect a person’s muscle control, body movement, muscle coordination, reflexes, and posture. Visual, learning, hearing and speech impairments can also be symptoms of cerebral palsy.
What Can Cause Cerebral Palsy?
Cerebral palsy is caused by an abnormality in brain development. The exact reason of this condition is often not known. However, in some cases, it is thought to be caused by a lack of oxygen to a baby’s brain.
There are a number of situations that can cause this condition. It can be caused during pregnancy, labor or childbirth. It is often linked to cases of medical malpractice or negligence. However, just because a baby is diagnosed with cerebral palsy, does not mean that malpractice was the cause. Some factors that could lead to this condition are infections during pregnancy, infant infections such as severe jaundice, or trauma during labor or the birthing process.
When it is Caused By Medical Malpractice
When a parent is told their child has been diagnosed with cerebral palsy, it is devastating. One of the first things that parents are immediately concerned with is how they will be able to properly care for their child. While monetary compensation cannot erase the damage, it can help alleviate many of the day-to-day medical expenses associated with a child that has cerebral palsy.
Hospitals, doctor and nurses have a responsibility to provide a certain standard of care. When they fail to do so and the result is damage to a child, they need to be help accountable. Some preventable medical mistakes that can cause cerebral palsy may include:
- Failure to treat an infection during pregnancy
- Improper use of vacuum extractor or forceps
- Failure to order a timely cesarean
- Untreated severe jaundice
- Excessive use of Pitocin to induce labor
- Failure to detect or diagnose other related issues
