What is Product Liability?
Product liability, sometimes referred to as products liability, is an area of law that holds manufacturers, designers and sellers of dangerous or defective products responsible for the injuries linked to their goods.
Product liability law encompasses negligence, strict liability and breach of warranty.
In a negligence case, the maker of a product owes a duty of care to the user to prevent a reasonably foreseeable injury. When a product that is carelessly designed or made causes a reasonably foreseeable injury, the manufacturer must be held liable for the injuries.
Strict liability applies when a product is sold in a defective condition that is unreasonably dangerous to an ordinary user. The defect that causes an injury may be linked to the way in which a product is designed, made or packaged. This includes instructions and failure to warn users of the product’s dangers. Under the theory of strict liability, it is not necessary to prove that the manufacturer was careless.
Many manufacturers sell their products with a warranty specifying that it is fit for a particular purpose or an ordinary purpose. If a product is defective, the manufacturer may be sued for breach of warranty.
What Types Of Products Precipitate Product Liability Suits?
Product liability is a broad area that encompasses just about any item imaginable – from consumer goods to prescription medicines. Here are some of the most common household items involved in product liability lawsuits:
- Household appliances such as toasters, ovens, dryers, space heaters, washers and dryers
- Car parts, including brakes, brake pads, steering wheels, seat belts, seats and airbags
- Medicines and medical products such as diet pills, birth control patches, antidepressants and hip implant devices
- Baby products such as cribs, strollers, carriers, car seats and infant toys
- Toys that pose choking, strangulation or lead paint hazards
- Tools, including welding equipment, power tools, lawnmowers and garage door openers
The time in which you may file a product liability lawsuit after an injury is limited in both Missouri and Illinois. It’s important to contact an experienced product liability lawyer as soon as possible after an injury to ensure that important evidence isn’t lost and that your claim is not barred by the state’s statute of limitations.
